As far as UK is concerned, moped is a legal term.

On a HMRC NOVA form for importing vehicles in to the UK, 'Style of Motorcycle' is moped for 49cc machines, even if it looks like a scooter.
e.g. a J series 125cc Lambretta would be a scooter and a J50 Lambretta would be a moped.

Plus,
There are mopeds I can ride on my car license - e.g. the spree/ aero like Honda Melodys - scooter looking with no pedals.
And there are mopeds I can't ride - e.g. Yamaha Fizzy - which have pedals and look like small motorcycles.
This also depends on when your driving test
