Bought a 97 Elite S Today
I've been buying and fixing lots of Tomos stuff lately, but when I saw this pop up a couple hours away, I went for it. She's all original, garage kept, and has 1869 miles. I'm stoked!

I've been looking for locals to meetup with!
I've got a garage AND carport full of peds n scoots.
It was raining all afternoon and night when I got home with this baby, but in the short bit I did ride it around... It feels GREAT. I knew I'd be in love, but man this scoot is exactly what I've been lusting for.
The only thing that it needs immediately is a center stand. Ladies can be quite hard on them. This one's is bent enough that the rear tire is on the ground. She said she transported it on the stand, so I'm not surprised.

To be called a moped in Florida, it needs to have pedals that can propel it. There are four terms.. Motorcycle, motor scooter, motorized scooter and moped. Read this article and buried in it you will see the rule referenced that lets you operate an under 50cc motor scooter on the street with a regular drivers license without a motorcycle endorsement:

When you title it, you can ask the tax assessor to set the body type to ms, although I have many Florida motor scooter titles that say mc for the body type.

It's amazing how well-sorted the ride and handling on these things is, even when we uh, - ahem - exceed the Gross Vehicle Weight Rating by a few pounds.
Yellow's a great color, and that example appears to be in pristine condition.
Your next mission, should you choose to accept it, is to de-restrict that S model and increase its speed to around 42 mph with better-than-decent acceleration. Nice find!

Really, 35? Maybe Florida lets the "restricted" models go that fast, but all the S models I've read about topped out at 30, or 25 in Iowa. Has the previous owner done a li'l de-restrictin' already?

I agree with Wheelman. I think the SEAL, MOVEABLE DRIVE FACE, aka "washer" has already been removed from the variator. Very tough to go over 30 with that in there. For starters though, the cover to the airbox is easy to remove. Once off, inspect the cover to see if it has been modified.

Probably. The lil British lady who owned it even had deleted the oil injection. Its premix, as I prefer. I wouldn't be surprised if the variator washer had been removed already.
It does 38 pretty easily. Maybe touches 40 with a slight downhill.
No obvious visible mods to the airbox, but I'll investigate further.
Its fun- the sucker leaves modded tomos in the dust to 35+
